Home > When FMLA Stands for the Friday, Monday Leave Act: Combatting Excessive Leave

While the purpose of the Family Medical Leave Act (FMLA) is an upstanding one, an unintended league of employees grow under its cover – permanent part-timers receiving the benefits of a full-time worker. While the number of employees abusing FMLA are difficult to ascertain, a 2014 survey by Littler Mendelson found that 69 percent of executives were concerned about FMLA abuse within their organization. Today, excessive and fraudulent leave matters are some of the most challenging for employers to manage.

How can organizations deal with FMLA abuse and excessive use concerns? How can organizations accommodate employees with serious medical conditions and legitimate work limitations while keeping FMLA abusers at bay? There are number of tools an organization can use including second and third opinions, and recertification– but one of the most effective and efficient tools is the Disability Interactive Process.

Learn how to use Rachel's straight forward and field-tested Disability Interactive Process Hallway to improve attendance and curb unnecessary leave.

In this session, you will learn how to:

  • Reduce unnecessary or misuse of leave in your organization.
  • Understand FEHA/ADA and FMLA/CFRA law as it pertains to disabled employees including both organization and employees obligations.
  • Employ a consistent disability interactive process which will lead you to reasonable accommodation decisions you can feel confident about.
