In today’s dynamic labor market, workplaces encompass a multitude of worker relationships, from traditional full-time employees (salaried or hourly) to part-time and independent workers. As the economy expands, organizations must adapt to leverage all types of work relationships to thrive. However, the law has not fully recognized the significance of these evolving arrangements, creating potential compliance challenges. This session will provide a comprehensive overview of how organizations can strategically manage this diverse workforce while addressing the legal implications under federal and state statutes. Attendees will gain insights into the risks associated with workforce mobility, particularly the use of independent contractors and gig workers, and explore strategies to mitigate liability in this complex legal landscape.  

Learning Outcomes:  

  • Identify and differentiate worker relationships to distinguish between various types of worker relationships.  

  • Assess legal risks and compliance obligations to understand the compliance obligations under federal and state statutes that may impact their organization’s liability. 

  • Develop strategic workforce management plans to meet organizational needs, while minimizing legal exposure and ensuring adherence to current laws.

Darrell is a distinguished labor and employment attorney known for his expertise in compliance with national and local labor laws, management best practices, and adapting to legal changes driven by technology and remote work. He provides specialized training to management teams on critical topics, including employee performance, internal investigations, leave laws, and sexual harassment.

With a broad industry focus including healthcare, hospitality, media, and higher education, Darrell excels in business compliance, investigations, labor relations, and trade secrets. His extensive career includes leadership roles at major law firms, serving as a Commissioner with the New York State Civil Service Commission, and working with the National Labor Relations Board.

Darrell’s education includes a J.D. from Columbia Law School, where he was a Charles Evans Hughes Fellow and served as Writing and Research Editor for the Human Rights Review. He also holds a B.A. from Fordham University.

A prominent figure in professional circles, Darrell has contributed to founding and leading organizations like the Minority Corporate Counsel Association and the National Employment Law Council. Nita Beecher, Of Counsel to Fortney & Scott, LLC, advises clients on a broad range of employment law issues with her primary focus on issues involving discrimination, affirmative action, compensation, and wage and hour matters. She serves as Legal Counsel for The Institute for Workplace Equality and co-editor of the Federal Employment Law Insider, a monthly newsletter updating employers on federal laws and regulations and presents webinars on federal employment law issues.

Prior to working for FortneyScott, Ms. Beecher served as in-house counsel in major corporations for over 20 years where she advised in-house clients on labor and employment law issues and developed a self-audit tool for OFCCP audits. Ms. Beecher also spent 10 years leading networks of senior diversity, EEO, and affirmative action corporate practitioners and of in-house labor and employment counsel.

 In 2011-2012, Ms. Beecher served as one of ten experts on the National Research Council of the National Academies panel which produced the NAS report, Collecting Compensation Data from Employers, requested by EEOC.

Ms. Beecher has been a regular speaker at many professional meetings, including the annual NILG conferences since 2004.

With nearly 30 years of experience, Camille has represented clients in employment discrimination, harassment, wage-and-hour disputes, and independent contractor matters across the country. 

Camille’s distinguished trial record includes serving as lead defense trial counsel in high-stakes cases involving harassment, discrimination, and systemic policy violations. She has also worked as outside counsel to boards of directors and executive teams on sensitive internal investigations. Her sophisticated approach to litigation has led to numerous successful resolutions, often on the eve of trial or through creative motion practice. 

In addition to her legal practice, Camille has regularly testified before the U.S. Senate, House of Representatives, EEOC, and Department of Labor on key legislative issues. She has served as the U.S. Chamber of Commerce’s chair of the Equal Employment Opportunity policy subcommittee since 2013, advocating for employer perspectives on critical employment laws. 

Camille earned both her B.A., with Highest Honors, and her J.D. from the University of Michigan. As an undergraduate, she was awarded the Eita Krom Scholar distinction for her published thesis. Her extensive legal and policy contributions make her a sought-after speaker and a leading voice in the field of complex litigation.
